Citizen Service Charter and Principles of Good Administrative Practice of the Illustrious Official College of Dentists of Cádiz

Preamble:

Article 13 of the Order of November 8, 2013 (BOJA No. 242 of December 12, 2013), which approves the modification of the Statutes of the Official College of Dentists of Cádiz and provides for its registration in the Professional Colleges Register of Andalusia, establishes among the College's functions the creation of citizen service charters, for the public information of the services it provides, as well as the rights related to them. Similarly, Article 108 establishes that the College will promote sufficient mechanisms for effective communication with patients and users of the dental services, as well as their representative associations, for which it will create a service charter and good administrative practice.

The Law 10/2003 regulating the Professional Colleges of Andalusia and the Decree 216/2006, which approves the Regulation of Professional Colleges of Andalusia, establish that professional colleges must create a citizen service charter that informs citizens about the services they provide, as well as their rights in relation to those services. These should be written briefly, clearly, and simply, in terms understandable to citizens.

Based on the above, the present Citizen Service Charter and Principles of Good Administrative Practice of the Illustrious Official College of Dentists of Cádiz is established.

1. Services provided by the Official College of Dentists of Cádiz.

The services provided by the Official College of Dentists of Cádiz are framed within the objectives and functions outlined in its current statutes:

The essential purposes of the College are:

   
1.  Achieving adequate satisfaction of the general public’s interests and society's interests, particularly in relation to the practice of dentistry.

    2.  Regulating the practice of dentistry within the legal framework and within its competences.

    3.  Exclusive institutional representation of the dentistry profession within its territorial scope, provided that it is subject to mandatory membership.

    4.  Defending the general interests of the profession, the professional interests of dentists practicing within its territorial scope, and ensuring their adequate satisfaction in relation to the dental profession.

    5.  Ensuring the appropriate quality level of the professional services provided by its members.

    6.  Monitoring that the activities of dentists and professional societies comply with the ethical standards of the profession.

    7.  Protecting the interests of patients and users of the services provided by its members, without prejudice to the competences of other administrations or institutions.

    8.  Collaborating with public administrations in all matters related to the professional activity of registered dentists.

    9.  Guaranteeing the right of citizens to know the name, qualification, and place of practice of each registered dentist.

The functions of the College are:

     1.  The creation of service charters for citizens, providing public information about the services offered, as well as the related rights.

      2.  Offering information about the contents of the profession, registered members, professional societies, and final sanctions imposed on them, as well as addressing inspection or investigation requests from any competent authority from an EU member state as stipulated in Article 5.u) of Law 2/1974, February 13, respecting personal data protection regulations.

     3.    Approving its statutes and internal regulations, as well as their modifications.

     4.    Representing and defending the profession within its scope before the Administration, institutions, courts, entities, and individuals, with the legitimacy to be a party in any litigation that affects professional interests in general or anyone in particular, in accordance with current legislation.

     5.    Regulating professional activity within its competences, creating ethical standards for the dental profession.

     6.    Taking necessary measures to ensure members fulfill their insurance obligations, and facilitating compliance.

      7.    Exercising the right of petition in accordance with the Law.

     8.    Organizing professional, cultural, welfare, social, and other similar activities and services of interest for members and society in general.

     9.    Creating and approving annual income and expenditure budgets, as well as accounts and financial statements.

     10.  Establishing and requiring financial contributions from members, both regular and extraordinary.

     11.  Handling the collection of professional fees or remuneration when a member requests it freely and explicitly, provided the College has established the appropriate service and under the conditions determined by the Governing Board.

     12.  Maintaining an updated register of all members that includes, at a minimum, a certified copy of the professional qualifications, date of registration, main professional address, and notification address if different, signature, proof of professional liability insurance, and any circumstances affecting their eligibility for professional practice. The register must also include the data referred to in Article 5.2 of Law 44/2003, of November 21, on the regulation of health professions, and other applicable regulations, with data transferred to public records in accordance with current laws.

     13.  Maintaining a register of professional societies with details such as business name, address, incorporation date, activities, professional members, and the identification of those responsible for management and representation.

     14.  Establishing indicative criteria for professional fees for use in legal cost assessments.

     15.  Providing information in administrative or judicial proceedings when required or when their intervention is foreseen by law.

     16.  Creating and maintaining a register of qualified experts in accordance with regulations, making the list available to courts, public administrations, and any legitimate interested parties.

     17.  Proposing and, if necessary, adopting measures to prevent professional intrusion, unfair competition, and illegal or misleading advertising, exercising the necessary legal actions.

     18.  Intervening in mediation, arbitration, and conciliation procedures, as well as resolving conflicts among members, between members and citizens, and between citizens, as agreed upon freely, in accordance with applicable regulations.

     19.  Improving professional activity and the ongoing training of members, collaborating with scientific societies and other public and private organizations, and creating scientific sections or commissions.

     20.  Exercising disciplinary authority over members and dentists practicing within its territorial scope according to Law 10/2003 regulating professional colleges in Andalusia, the college’s statutes, and current legislation.

     21.  Participating in consultative bodies of the Administration when required or requested.

     22.  Informing on legislative projects of the Autonomous Community concerning professional practice conditions or those directly affecting professional colleges, without prejudice to the competences of the Andalusian Council of Official Dentists.

     23.  Exercising any administrative competences legally attributed to them and collaborating with public administrations through agreements, studies, or reports, as well as monitoring situations affecting members who are public employees in cases of incompatibility.

     24.  Ensuring compliance with laws, college statutes, and internal regulations by its members, as well as agreements made by college bodies.

     25.  Those attributed by other legal or regulatory norms, delegated by public administrations, or arising from collaboration agreements.

     26.  Collaborating with the University in the development of dental study programs, respecting the principle of university autonomy.
